& CONDITIONS 2011 United Cellars Competition –Win a Bordeaux En Primeur
portfolio valued at $5000.00!
- Information on
how to enter the Promotion forms part of these terms and conditions. Entries
not made in accordance with these terms and conditions will be disqualified.
Acceptance of the major prize by the major prize Winner is deemed acceptance of
these terms and conditions.
- The Promotion
commences on 1/2/11 and closes at 1.00pm on 31/12/11 ("Promotion
Period"). All times recorded throughout these terms and conditions are in
Eastern Standard Time. The Promoter is United Cellars Australia P/L, 179-181 Palmer Street
Darlinghurst NSW 2010 & Telephone 1300 586 483. (ABN 95 111 797 623)
("Promoter").
- Entry is only
open to Australian residents, aged 18 years or over who comply with the entry
criteria in accordance with these terms and conditions. Employees of the
Promoter and their immediate families, participating agents and their agencies
associated with this Promotion are ineligible to enter. The Promoter reserves
the right to verify the validity of each entry. The Promoter reserves the right
to disqualify any person for tampering with the entry process.
- Entry to the
competition is possible via the internet, email, SMS, phone 1300 586 483 or via
the website www.unitedcellars.com.au. The cost of a call to enter the
competition will not exceed 55 cents (including GST).
- A
representative of the Promoter will conduct a random draw of all submitted
entries. One (1) major prize winner will be manually selected at random from a
computer-generated listing of entries that comply with these terms and
conditions over the Promotion Period. There will be a total of one (1) major
prize awarded. There will be one (1) draw for the one (1) prize and the first
valid entry drawn will be the winner of the major prize listed below in clause
6. The draw will take place at 1.00 pm on 04/01/2012 at United Cellars, 179-181
Palmer Street Darlinghurst NSW 2010. Attempts will be made to notify the Prize
Winners by mail or email and telephone by 10/01/2012.
- The total
prize pool is valued at up to AU $5,000 and consist of: A portfolio of Wines
from the 2010 Bordeaux
vintage valued at $5000. The total volume of alcohol in the wine component of
the prize does not exceed 20 litres.
- Collection of
the prize, including transport to and from airport for departure/arrival
(except where specified), additional transfers and all other ancillary costs
are the sole responsibility of the winner.
- If a Prize
Winner wishes to claim their Prize, the Prize Winner must confirm this fact and
his/her eligibility to win under these terms and conditions by 12.00pm on
12/01/2012. If the Prize Winner fails to do either or both of these things by
the deadline, that Prize Winner will be deemed to have forfeited the prize.
- In the event
that any Prize Winner forfeits the Prize or a Prize remains unclaimed the
Promoter will conduct a redraw for the unclaimed Prizes only, following the
same procedure as the original draw. The redraw will take place at 3.00pm on
14/01/2012 at the same place as the original draw.
- Attempts will
be made to notify the Prize Winners from any redraw by mail or email and
telephone by 18/01/2012. In the event that this redrawn Prize Winner is not
eligible, the Promoter will conduct a redraw until the Prize is awarded
(subject to any further regulatory directions).
- The Prize is
not transferable to other persons or organisations. The Prize is not redeemable
for cash and cannot be taken as cash. If a Prize or receipt of it incurs a tax
liability, the relevant Prize Winner is liable for payment of such tax. In the
event of a dispute, the decision of the Promoter is
final and binding and no correspondence will be entered into.
- Subject to
the State legislation the Promoter reserves the right to substitute the Prize
in whole (or any of its components), with a substitute prize of equal or
greater value and the Prize Winner will be notified accordingly.
- The Prizes
cannot be used in conjunction with any other special offer.
- Neither the
Promoter nor any other person or party associated with the Promotion shall be
liable for any loss or damage whatsoever suffered (including but not limited to
direct, indirect, consequential or economic loss) or personal injury suffered
or sustained in connection with either participation in the Promotion or with
any Prizes offered, except for any liability that cannot be excluded by law.
The Promoter will not be responsible for any delayed, lost or misdirected mail,
email or any other communication. Further, to the fullest extent permitted by
law, the Promoter excludes liability for any problems or technical malfunction
of any telephone network or lines, computer online systems, servers, or
providers, computer equipment, software, technical problems or traffic
congestion on the Internet or any Website, or any unauthorised intervention, or
any combination thereof, including any non-delivery or corruption of entries to
the Promoter, injury or damage to participants or any other person’s computer
related to or resulting from participation in or down-loading any materials in
this competition. The use of any automated entry software or any other
mechanical or electronic means that allows an entrant to automatically enter
repeatedly is prohibited and will render all entries submitted by that entrant
invalid.
- By entering
this Promotion, unless otherwise advised by the entrant, each entrant consents
to the retention and use of his/her information by the Promoter and/or
Prizegiver. For details about who we are, how we may use your information and
what your rights are under the new privacy laws, please see our Privacy Policy,
which is available from United Cellars at www.unitedcellars.com. Uses
may include future promotional, marketing and publicity purposes without any
further reference or payment or other compensation to the entrant, or
distribution of marketing materials for goods or services from the Promoter or
from companies in which the Promoter holds shares.
